Definitions

  1. Victory in Europe Battlefield Tours: VE-Tours, located in Belfeld. 

  2. Customer: the person with whom VE-Tours has entered into an agreement.

  3. Parties: VE-Tours and the customer together.

  4. Consumer: a customer who is also an individual and who acts as a private person.

These general travel and booking conditions apply to all offers and agreements of and with  Victory In Europe Battlefield Tours hereinafter referred to as VE-Tours. 

Changed conditions apply immediately from the moment of publication on www.ve-tours.com for all offers and agreements.

1. Formation of the travel agreement

1.1 

By completing and sending the booking form on the VE-Tours website, the traveler accepts the offer of VE-Tours. 

The traveler thereby agrees to the general travel and booking conditions of  VE-Tours.  . 

A telephone booking must be confirmed by the traveler by e-mail before it is recognized as a booking by VE-Tours. Unless otherwise agreed by both parties.

If the booking can be made in accordance with the traveler's wishes, VE-Tours  will immediately send a confirmation of the travel agreement to the traveler, but no later than within 7 working days. This concludes the travel agreement between the traveler and VE-Tours.

1.2

The adult person who enters into an agreement for himself or (also) for the benefit of other travelers is jointly and severally liable for all obligations arising from the agreement.

1.2.1

The minor person must have permission from a legal parent or guardian to book a tour with VE-Tours.com.

1.3

An offer from VE-Tours is without obligation and can be revoked if necessary.           _cc781905-5cde-3194 -bb3b-136bad5cf58d_       

Revocation will take place within 7 days at the latest without giving reasons. 

The traveler is then entitled to a 100% refund of any monies paid.

If the tour will take place within 7 working days, the traveler must communicate this with VE-Tours within 24 hours

1.4 

The published travel sum per tour  is the travel sum per person unless stated otherwise. This includes  the published features and activities, but excludes any optional capabilities.

1.5

VE-Tours does not consider itself liable for errors and mistakes in their offer, whether in pricing or other conditions, which should be recognizable as such from the perspective of the average traveler.

1.6

Under no circumstances can we guarantee that special requests will be met, nor can we confirm them in advance. VE-Tours will do its utmost to meet the wishes.

 

Special wishes include, for example;

  • dietary requirements

  • seats in the bus

  • additional stops

  • additional places to visit

Any additional costs in connection with special wishes (with the exception of dietary wishes) will be borne by the traveler.

2. Terms of Payment

2.1

Payment must be made immediately for online bookings by invoice, iDeal, PayPal or credit card. If agreed otherwise, the payment agreements agreed in writing will apply.

2.2

In the event of late payment, the traveler will receive a payment reminder with a request to pay the amount due immediately. If payment has not been received after seven  working days, the agreement will be deemed to be  canceled on the first day of payment default. bb3b-136bad5cf58d_

VE-Tours will charge cancellation costs in accordance with the cancellation policy in Article 4.1.

2.3

The traveler who has not fulfilled a payment obligation on time, owes statutory interest on the outstanding amount, in accordance with Article 6:119 of the Dutch Civil Code. The traveler is also obliged to reimburse extrajudicial collection costs in accordance with the Decree on compensation for extrajudicial collection costs.

3.  Travel information

3.1 

If the travel sum has been paid in full, VE-Tours will send the travel information to the traveler no later than 14 days before departure, unless this cannot reasonably be expected from VE-Tours.

3.2

If the traveler has not received the necessary information 5 working days before departure, then  will immediately report this to VE-Tours.

3.3 

If a trip is booked within a shorter time frame than 10 days before 

departure, VE-Tours informs the traveler how the necessary information is transferred.

3.4

Taking out suitable travel, accident and/or cancellation insurance is a requirement.

VE-Tours knows for the toursnocancellation and/or travel insurance. This serves the travelerby myselfwith an insurance company of your choice.

4. Cancellation by traveler

4.1

If the traveler cancels the travel agreement, he owes the cancellation costs stated below of the total travel sum including the booking costs.

4.2

In the event of cancellation of an agreement by one or more travelers who have jointly  a tour, the cancellation of all agreements applies, so that all travelers must pay the amounts as mentioned in the previous paragraph. If the remaining travelers wish so and their group size is included in the offer of  VE-Tours, their agreements will remain in effect whereby the travel sum must be paid as stated in the offer for the remaining number of travelers .

4.4

Cancellation of the travel agreement must be made known by e-mail or registered letter , whereby the date of dispatch counts as the cancellation date. 

The cancellation is considered final after written confirmation of receipt from  VE-Tours.

4.5

VE-Tours knows for the toursnocancellation and/or travel insurance. This serves the travelerby myselfwith an insurance company of your choice.

5. Cancellation and change by VE-Tours

5.1

VE-Tours has the right to cancel the agreement due to serious circumstances. Significant circumstances are understood to mean circumstances of such a nature that further commitment to the agreement by VE-Tours cannot reasonably be expected. This is the case, for example, if there are fewer registrations for the tour than the stated minimum.

If VE-Tours cancels the trip due to serious circumstances, the traveler will receive a full refund of the already paid travel sum.

5.2 

VE-Tours has the right to change the agreement on one or more essential points due to important circumstances. The change will be made known to the traveler within 3 working days. If the change takes place within 24 hours before the day of departure, this change will be discussed and substantiated orally on the day of the tour.

6. Liability

6.1

Participation in a Battlefield Tour / memorial trip is entirely at your own risk.

6.2

The VE-Tours team is not liable for any damage whatsoever that the participant may suffer as a result of a tour.

6.3

VE-Tours is also not liable for loss, theft or damage to property, unless the damage can be proven to be intentional or can be proven through gross negligence attributable to the Battlefield Tour guide(s) or one of the VE-Tours team members.

6.4

VE-Tours is also not liable for property that you have lost during a tour. 

6.5

We will keep items that we find in the buses at the end of the day, which you will of course receive back.

6.6

Tour programs are always subject to change, VE-Tours is partly dependent on third parties and external (weather) conditions. As a result, it may be possible that a tour will not proceed according to the program and the relevant tour leader and or guide will act at their own discretion and offer an appropriate solution.

6.7

VE-Tours cannot be held liable for delays, schedule changes, delays in the performance of services by third parties as a result of force majeure. 

7. Traveler Obligations

7.1

The traveler is obliged to report significant physical limitations and medical facts to   VE-Tours. 

VE-Tours reserves the right to exclude travelers from activities or further participation if, in their opinion, mental or physical problems do not or only partially allow responsible execution of the agreement. Costs of resulting damage or loss of travel enjoyment cannot be recovered from VE-Tours.

7.2

The traveler is obliged at all times to follow the instructions of the tour guide, tour guide and bus driver.

7.2a 

The traveler is at all times obliged to follow the instructions of the hotel, museum, other authorities and institutions.

7.3

The traveler is obliged to behave in such a way that he does not or cannot cause any nuisance or inconvenience that hinders the proper execution of the agreement. The traveler must also comply with applicable rules in restaurants, museums or other accommodation such as a smoking ban, Covid-19 measures, etc.

7.4

The traveler must be in possession of a valid passport or proof of identity on departure and during the trip in connection with the law on identification.

 

8. Complaints

8.1

VE-Tours does  its utmost to carry out the tours to everyone's satisfaction. In the unlikely event that something does not go according to plan, the traveler must report this to the tour guide present during the tour so that he can find a suitable solution. If this solution is not or not satisfactorily reached, the traveler must immediately report this to VE-Tours in the form of a written complaint to be sent to:

VE-Tours will then receive your complaint10 working daystake care of. A suitable solution will then be sought.

8.2 

If the complaint has not yet been resolved satisfactorily after this, the traveler must submit this at the latestamonth after the end of the trip in writing and substantiated to report to  VE-Tours.

Appearanceamonth after receipt of the complaint, VE-Tours will provide a substantive response in writing.

8.3

If it appears that the complaint has not been submitted in time and has not given VE-Tours the opportunity  to remedy the shortcoming, any right to compensation can be excluded.

8.4

Dutch law applies to all disputes between VE-Tours and travelers.

9. Other

9.1

All amounts stated in these terms and conditions are, where applicable, inclusive of VAT.

9.2

Changes and deviations from or additions to these general terms and conditions  must be expressly confirmed in writing by VE-Tours or will be announced via the website.

9.3

Any disputes that cannot be resolved in an appropriate manner between VE-Tours and the traveler will be submitted exclusively to the court in Roermond.
